1) Who we are
These Terms of Service (“Terms”) govern your use of the websites, client portal and publications operated by Banyantree Investment Group Pty Ltd (ABN 97 611 390 615), holder of AFSL 486279 (“Banyantree”, “we”, “us”, “our”).
2) Agreement to these Terms
By accessing our website, portal or publications (together, the “Services”), you agree to these Terms. If you do not agree, please do not use the Services.
3) Audience and eligibility
Our Services are designed for wholesale clients and professional investors. Some content or features may be restricted. You must be at least 18 years old and have legal capacity to use the Services. Do not access the Services where doing so would be unlawful.
4) General information only — not personal advice
Content on the Services is general information and does not take into account your objectives, financial situation or needs. Nothing on the Services is a recommendation, offer or invitation to acquire or dispose of any financial product. Past performance is not a reliable indicator of future performance.
5) No offer or distribution where unlawful
Nothing on the Services constitutes an offer or solicitation in any jurisdiction where it would be unlawful or where we are not licensed to make such an offer.
6) Accounts and access (client portal)
If you receive portal access, you must:
keep your credentials confidential and secure;
ensure information in your account is accurate and up to date;
notify us promptly of any unauthorised use or security issue.
We may suspend or terminate access at our discretion (for example, for security or compliance reasons).
7) Market data and third-party content
The Services may include data or content from third parties. We believe such information to be reliable, but we do not guarantee it is complete, current or accurate. Links to third-party sites are provided for convenience only and we are not responsible for their content or practices.
8) Submissions and “Trader Corner”
If you submit an idea or materials (including via Trader Corner):
Ownership: you retain ownership of your idea.
Confidentiality: we treat submissions as confidential within Banyantree and maintain a record of what was received and when.
Use: you grant us a non-exclusive, royalty-free licence to review, evaluate and use the submission internally and to maintain records for compliance.
Attribution: if we wish to reference, attribute or share your idea externally, we will seek your written consentfirst.
No obligation or payment: sending an idea does not create any obligation for us to act, respond, publish or pay compensation.
Your warranties: you warrant you have the right to submit the materials and that they do not include confidential, restricted or inside information and do not infringe any rights of others.
9) Acceptable use
You must use the Services lawfully and must not:
interfere with or disrupt the Services or security features;
introduce malware, scrape without permission, or attempt to gain unauthorised access;
use the Services to harass, mislead, defame or infringe rights;
submit content that is unlawful, misleading, promotional spam, or that you do not have the right to provide.
10) Intellectual property
Unless stated otherwise, the Services and all content on them are protected by copyright, trade marks and other rights owned by us or our licensors. You may view and print reasonable extracts for your personal or internal business use. Any other use (including reproduction, distribution or modification) requires our prior written consent.
11) Privacy and cookies
Our Privacy Policy explains how we collect, use, disclose and protect personal information and how we use cookies and similar technologies. By using the Services, you acknowledge our Privacy Policy.
12) Research independence and disclosures
Where we publish research or commentary, we apply our Research Independence Policy and make appropriate disclosures of material interests and relationships, where relevant.

We may change, suspend or withdraw any part of the Services at any time. We may update these Terms from time to time; the updated Terms apply from the “Last updated” date above.

Content may include forward-looking statements or views based on assumptions and available information at the time. Actual outcomes may differ. All investments involve risk, including possible loss of principal.
15) Disclaimers and liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available”. We exclude all warranties not expressly set out in these Terms.
To the extent permitted by law, we are not liable for any loss (including consequential or indirect loss, loss of profit or business interruption) arising from your use of, or reliance on, the Services or any linked site. Nothing in these Terms limits liability that cannot be excluded under applicable law.
16) Indemnity
You agree to indemnify us against losses, costs or liabilities arising from your breach of these Terms or misuse of the Services.
17) Complaints and dispute resolution
If you have a concern, please refer to our Complaints & Dispute Resolution (IDR) Policy for how to complain, response timeframes and external escalation options. We’ll work to resolve issues promptly.
18) Termination
We may suspend or terminate all or part of the Services, or your access, at any time. On termination, the provisions that by their nature should continue (including intellectual property, liability, indemnity and governing law) will continue.
19) Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
20) Severability
If any part of these Terms is invalid or unenforceable, the remaining parts continue in full force.
21) Entire agreement
These Terms, together with any policies referenced here (including the Privacy Policy, Research Independence Policy, Conflicts of Interest Policy and Complaints & IDR Policy), form the entire agreement between you and us in relation to the Services.
